The number of activations of the camera by vehicles travelling in excess of the trigger speed. This figure is logged by the camera operator.

Notices of Intended Prosecution (NIP’s) issued

The number of NIP/172 Notices issued in respect of offences detected that are eligible to be dealt with by way of the conditional offer fixed penalty procedure.

This will exclude (currently) offences involving:

  • Vehicles the number plates of which can not be satisfactorily read to be able to verify the identity of the vehicle:
  • Vehicles travelling at excessive speeds that would render the driver liable to automatic disqualification:
  • Vehicles operated by the emergency services in circumstances where compliance with the speed limit or traffic signal would hinder the use of that vehicle for the purpose to which it is being used (Sec. 87 RTRA 1984; Reg. 36(1)(b) TSR&GD 2002)
  • Vehicles that are not registered in the UK (ongoing discussions with EU states may result in this changing in the near future).

Conditional Offers (CO’s) and Fixed Penalties Paid

The number of payments in respect of offences detected where the issue of a NIP/172 has resulted in a subsequent admission of driving and compliance with the requirement to submit a valid UK driving licence, together with full payment of the due amount, within the stipulated suspended enforcement period.

Discrepancy between ‘Photographs’ & ‘Paid’

The offer of a fixed penalty can only be made when there has been an admission of driving.

Drivers are identified through the registered keeper of the vehicle with the onus on the registered keeper to provide information as to who was driving the vehicle at the time of the alleged offence.

Where the registered keeper of a vehicle fails to provide information that would lead to the identification of the driver, the Conditional Offer Fixed Penalty procedure cannot be initiated and consideration will be given instead to a court prosecution against the registered keeper for failing to provide information.

Where a driver admission is received and the conditional offer of a fixed penalty is made, that offer will be rescinded if the driver subsequently fails to, or is unable to, comply with the conditions under which it is made, namely that:

  • The driver is the holder of a valid UK driving licence on which there are no more than 8 current penalty points.
  • Full payment of the fixed penalty is made within the stipulated suspended enforcement period, and
  • The valid UK driving licence is submitted with payment in order that it might be endorsed.

When the offer of a fixed penalty is rescinded in such circumstances, subsequent proceedings in respect of the original alleged offence will be by way of a court prosecution.

Where it is not possible to trace a current keeper of a vehicle in order to identify the driver at the time of an alleged offence, no proceedings will be taken against the last known registered keeper provided that that person has notified the appropriate authority that the vehicle has been sold or transferred.

Low-speed offenders may be offered a “Speed Awareness Course” as an alternative to penalty points and a fine. These offences are removed from the system before the Conditional Offer stage.
