Dwight Yorke was smiling as he was successful in his defense against a charge of excessive speed.
He was let off on a technicality, after failing to sign Section 172, declaring who was driving at the time.
But motorists should be warned that this is not a pass to freedom for speeding. Failure to sign S172 is also an offence in its own right and carries the same penalties as excessive speed*.
In Thames Valley it has always been our policy, if a driver fails to sign S172, to prosecute for failure to provide the requested information.
So what was a successful case claim for Yorke, could be an own goal for others who take a chance after this ruling.
*The current maximum penalty for this offence is a £1,000 fine and 3 penalty points
